Terms & Conditions

Welcome to The Buttercream Factory!

These Terms & Conditions explain our ordering process, payment requirements, production timelines, and customer responsibilities. By placing an order with The Buttercream Factory (“TBF”), you agree to the applicable terms outlined below.

1. Products & Services

The Buttercream Factory specializes in freshly prepared desserts, celebration cakes, custom cakes, and specialty orders.

Our products are made to order and may include personalized designs, flavors, fillings, and decorations.

We currently offer local pickup and delivery in eligible areas. Shipping is not available at this time.

2. Orders & Acceptance

Submitting an order or inquiry does not automatically guarantee acceptance or availability.

An order is confirmed only after The Buttercream Factory has accepted the order and received the required payment.

Production, baking, and purchasing materials specifically for an order will not begin before the required payment has been received and the order has been accepted.

Customers are responsible for reviewing their order details, including:
• Product selections and quantities
• Cake sizes, flavors, and fillings
• Names, ages, and personalized messages
• Design preferences and inspiration images
• Event dates and fulfillment arrangements
• Pickup or delivery information

Please ensure all information is accurate before submitting your order.

3. Custom Designs & Handmade Products

Our products are individually prepared and decorated.

While we make every reasonable effort to achieve the requested design, handmade products may have slight variations in color, placement, texture, and decorative details.

Inspiration photographs are used as references and do not guarantee an identical reproduction.

Certain designs may require adjustments based on product size, materials, structural requirements, or available decorating techniques.

Any significant design changes will be discussed with the customer when reasonably possible.

4. Payments & Custom Invoices

Payment methods available for an order will be displayed at checkout or specified on the customer's invoice.

Standard website orders generally require payment in full at checkout.

Custom cakes, weddings, and larger event orders may require a nonrefundable retainer.

The retainer amount and applicable payment schedule will be clearly identified on the custom invoice.

Custom invoices are generally valid for 48 hours unless otherwise stated.

Remaining balances are generally due seven calendar days before the scheduled fulfillment date.

Orders totaling less than $100 or scheduled within 14 calendar days generally require payment in full when invoiced.

Payment arrangements may be available for qualifying custom or event orders when approved by TBF.

Third-party installment or financing options, when available, are subject to the payment provider's eligibility requirements and approval.

An order is not confirmed until the required payment has been received and accepted by TBF.

5. Late Payments

For custom and event orders with an outstanding invoice balance, a one-time $25 late fee may be assessed when payment is not received by the agreed deadline.

The outstanding balance and applicable late fee must be paid within 24 hours after the fee is assessed.

Failure to complete payment may result in cancellation of the order.

The late fee does not apply to standard website orders that were paid in full at checkout.

6. Order Changes & Corrections

Customers should review their order confirmation immediately.

Requests to correct an order should be submitted within one hour of placing the order.

For orders placed overnight, corrections should be submitted by 8:00 AM Central Time on the next business day.

Requests are subject to the order's production status and may not always be accommodated.

Once production begins, changes may be declined.

Additional charges may apply to approved modifications.

7. Production & Lead Times

Our general processing timelines are:
• Standard pickup orders: 2–3 business days
• Custom cakes and specialty designs: 1–2 weeks
• Weddings and large event orders: 4–8 weeks

Business days generally refer to Monday through Friday, excluding holidays and announced closures.

These timelines are estimates and may vary depending on order complexity, seasonal demand, and production availability.

Customers are encouraged to order early for holidays, weddings, and major celebrations.

8. Rush Orders

Rush orders may be available depending on production capacity.

Additional rush fees may apply.

Rush orders are accepted only when TBF confirms availability and receives the required payment.

Once a rush order has been confirmed, customer-requested changes and cancellations are not permitted.

If TBF is unable to fulfill an accepted rush order, we will contact the customer to determine an appropriate resolution.

9. Pickup & Local Delivery

Customers must select an available pickup or delivery option when ordering.

Pickup arrangements and delivery eligibility will be communicated through checkout, invoice, or order confirmation.

Customers are responsible for providing accurate delivery information and ensuring that someone is available to receive the order.

Once an order has been handed to the customer or an authorized recipient, responsibility for proper handling, transportation, and storage transfers to the recipient.

Please review our Pickup, Local Delivery & Product Care Policy for additional information.

10. Allergens & Dietary Information

Our products may contain or come into contact with common allergens, including milk, eggs, wheat, soy, peanuts, and tree nuts.

Our kitchen handles these ingredients, and shared equipment and preparation areas may be used.

We make reasonable efforts to accommodate disclosed preferences when possible; however, we cannot guarantee that any product is completely free from allergens or cross-contact.

Customers with allergies or dietary concerns should contact us before placing an order.

11. Cancellations & Refunds

Because our products are perishable and often personalized, all sales are generally considered final, subject to the cancellation and resolution provisions outlined in our Returns, Refunds & Cancellations Policy.

Cancellation eligibility depends on the type of order, scheduled fulfillment date, payment arrangements, and production status.

Custom and event orders may include nonrefundable retainers and additional cancellation conditions.

Customers should review the applicable cancellation policy before ordering.

12. Customer Communication

TBF may communicate with customers through email, telephone, text message, or other contact methods provided during the ordering process.

Customers are responsible for responding to requests for information, design approvals, and payment reminders within the stated deadlines.

When a cancellation is requested verbally, TBF will provide a written summary for the customer's review and confirmation.

The original date and time of the verbal cancellation request will be documented.

13. Website Information

We make reasonable efforts to keep product descriptions, prices, photographs, and availability information accurate.

Occasional errors or changes may occur.

If an error materially affects an order, we will contact the customer to discuss the available options.

Website content, product photographs, and original designs belonging to TBF may not be reproduced or used commercially without authorization.

14. Policy Updates

The Buttercream Factory may update these Terms & Conditions as business practices, products, or services change.

The current version will be available on our website.

Nothing in these Terms & Conditions is intended to waive or limit any rights or remedies that cannot legally be excluded under applicable law.
